Music publishers file copyright suit against LimeWire

Eight members of the National Music Publishers’ Association (NMPA) filed a copyright infringement suit in US District Court for the Southern District of New York, the NMPA said in a statement.

They accused LimeWire of “copyright infringement of their musical works on a massive scale” and are seeking unspecified relief and damages.

“The pervasive online infringement facilitated by LimeWire and others like them has consequences for everyone in the music chain,” NMPA president and chief executive David Israelite said.

Rumors of a Google-backed music service aren't necessarily new by any means but CNET has recently re-fanned the flames by citing “multiple music industry sources” as saying “Google could launch a music service that offers song downloads and streaming music as early as this fall.”

The search engine giant has several things going for it when it comes to trying its hand at a music service. For starters—and perhaps most importantly–it's already got several million user accounts in place, so trying to convince people to sign up for a new service won't be much of an issue.

Google's also made no qualms about its development efforts being “mobile first” as far as priorities go. With Android phones starting to really take hold, it'll have plenty of connected devices for streaming and downloading music through an integrated software player on Android handsets. And let's not forget about Chrome OS that's due out this fall as well. Seems like an opportune time to announce a cloud-based streaming music service, too.

Google has plenty of experience in the cloud, so the idea of an iTunes-like music store that kept all of your music online for easy streaming isn't too hard to imagine. You'd think there would have to be some sort of downloading option as well, so perhaps Google would offer different pricing schemes based on whether you just wanted to stream your music to connected devices or download it for good.

So a lot of potential customers, a solid mobile market in place, and the infrastructure to store everything online are all big advantages for Google, but what are some of the obstacles it might have to overcome?

I'd venture to say that out of all of Google's products—perhaps with the exception of Gmail—the user interface for Google Music absolutely has to be done right the first time and it should be fully baked before it's released. If Google wants to seriously compete with iTunes, it can't dump out a directory of links, slap a beta tag on it, and incrementally update it along the way. It needs to give people a reason to leave iTunes and never look back. Forget us early adopters and go directly after the masses with this one.

Google also needs to make it easy for people to transfer their music libraries into Google music. I'm not quite as worried about this one because I think the company's got the chops to make it relatively seamless, but it's still important that it's not overlooked. Again, you want people to leave iTunes, not start a second music collection on Google music. People want all their music in one place just like they want all their e-mail in one place. People switched to Gmail because it had a better interface and offered better features than other free e-mail services like Hotmail and Yahoo! Mail.

Finally, I realize not everyone uses iTunes but I'm using it as an example since it's arguably the most popular music service around. The thing iTunes has going for it, as well, is that it doesn't just sell music anymore. Perhaps not right away, but very soon, Google will need to expand beyond music and start offering TV shows and movies too. It's got the infrastructure in place since it already owns YouTube and has been experimenting with paid content on that platform. If people had the option to buy TV shows and rent or buy movies on Android handsets and Google TV as easily as it can be done on the iPhone, Google could leverage its paid YouTube content much more efficiently.

The San Antonio-based band Hacienda will be hitting the road this summer, in support of their new full-length album “Big Red & Barbacoa” (on Alive Records), for a tour with Grace Potter & The Nocturnals that kicks off June 12th in NYC. And if this knockout double-bill wasn't enough, Hacienda will, once again, be joining Black Joe Lewis & The Honeybears for a handful of Midwestern dates starting June 26th in Lawrence, KS.

“Big Red & Barbacoa” is the second album by South Texas' Hacienda, and like its predecessor Loud Is The Night (Alive 2008), it was produced by Dan Auerbach of The Black Keys. Recorded on the tail-end of a year playing clubs and festivals across North America, Australia and Europe (opening for Dan Auerbach and Dr. Dog, and more recently for Alberta Cross), this new album brings heavier grooves and flavor to the '60s harmonies sound the band is known for. The result is a blend of Tex-Mex roots rock, retro-pop and R&B that can only be described as South Texas Soul. “Big Red & Barbacoa” captures the attitude of a band ready to throw pretension to the roadside and play rock'n'roll the way it was intended.

Not everybody realizes just how many careers music has to offer. Yesterday we reported on a music-streaming iPhone application called Rdio that has been waiting for weeks to have an update approved by Apple. Now we’ve learned that this may be part of a new trend: MOG, the music portal that offers an impressive on-demand streaming music service, is also having issues with the App Store. MOG submitted its iPhone application over a month ago, and has heard nothing from Apple since. Phone calls and emails have gone unreturned. And the company is understandably getting nervous that Apple may be thinking of blocking the app.

MOG has a lot riding on its mobile applications — it just closed a new $9.5 million funding round, some of which is going toward expanding its mobile platform. At SXSW it held a press event to preview its iPhone and Android applications, and what it showcased was pretty impressive. For $10 a month, users can stream any song or album they want, and they can locally download entire albums to their phone (which will work even when they lose connectivity) in one tap.

It’s possible that Apple is concerned that MOG’s app is too good. If you listen (and pay for) a lot of music, MOG’s all-you-can-eat service can quickly pay for itself. And it makes tethering your iPhone to your PC every time you want to sync songs a thing of the past. Apple has long been been rumored to be working on its own cloud music service, especially since it acquired Lala last December, and may be worried about getting beaten to the punch. Thing is, Apple has already approved Rhapsody, which offers much of the same music streaming functionality (albeit without the full-album download button) and Spotify.

On the other hand, Apple may just be overwhelmed — it has the release of the iPhone 4 and iOS 4 just around the corner, and now has to deal with developers who are upgrading their apps in time for the new OS launch.

We’ll be keeping an eye on this to see how it develops.

well, i(''s sunday afternoon and i've got time enough to respond, which also allows me to avoid working on a new draft, although there isn't much meat to chew on here. if one was promised a wireless syncing app when they purchased a phone and it was not available, seems like grounds for a complaint to the seller for misleading advertising and if you're steamed enough, then organize and rally and get a class action lawsuit going. but the doj? hmmm?

my pops is a sports car nut and has had severa. he wanted the morgan company to add some features that some other cars had, but they wouldn't. of course, he could go to an indie and get it done, then making his warranty void. it's not really my business what the standards of approval are, anymore than morgan has to spell out why they won't install his carb change. they like the morgan the way it is produced and want to keep it that way. it is there biz.

if my music store didn't carry every thing i personally wanted, then i probably have desires beyond what my store offers and it sounds like you have a lot of other gripes as well. there's no limit to what people want. there were tons and tons of gripes about free apps not being perfectly executed, about having ads on them, so people will always complain, it seems. maybe you have some other points which might possibly hold legal merit, but this example is a far cry from one.

Designer Frederik Podzuweit has developed an innovative device to allow the deaf to enjoy music – synesthetic headphones which employ direct vibrations to the skin.

As revealed over on The Design Blog, the device, which is purely a concept for now, aims to tap in to the concept of ’synesthesia’ – a neurological condition which causes sensations gathered by one sense to be perceived by another: smells that have color, colors that have taste, and tastes that produce sounds, for example.

While synesthesia is often thought of as an unwelcome condition, attempts have been made in the past to create a voluntary form of the experience – most frequently in computer games, with music-based shooters such as Rez being one of the first to attempt to match vibrations, visuals, and music in a complete synesthetic experience.

It is this voluntary synesthesia that Podzuweit is attempting to harness with his invention: by causing the sounds – which a deaf person is unable to sense – to be detected as vibrations on the skin – which the deaf person can sense – it is possible to experience music without ever using your ears.

The Music for Deaf People device takes the form of a collar which is worn over the neck and shoulders and connected to your music source – an MP3 player, iPod, mobile handset or the like.  Play, pause, track skipping and ‘volume’ control – which actually adjusts the force of the vibration effect – are available via easy-to-access buttons on the ends of the collar, making the device suitable for use by those whose fine motor control skills aren’t what they once were as well as the younger deaf set.

Once triggered, the device translates the bass, midtones, and treble into distinctive vibrations – making it possible for a deaf person to distinguish music with surprising clarity, albeit without actually ‘hearing’ anything.

It’s an interesting concept design, and while it would take quite some time to get used to – after all, centuries of evolution have lead to touch and hearing being used in very different ways – it represents one of the first projects designed to bring the convenience and enjoyment of modern portable music playback devices to the deaf community.

While it’s a neat device, the Music for Deaf People ‘neckphones’ remain a design concept – and, thus far, Podzuweit hasn’t revealed any plans to put the device into production.  Hopefully there are companies out there looking to get the deaf dollar – Apple, are you listening here? – who would be interested in helping Podzuweit  bring the interesting concept to fruition.

The Email client on the BL40 is just the same as the SMS client in the device. The mail client supports an attachment limit of 2MB and Office and PDF files amongst the standard jpegs. Any compressed file formats can be safely regarded as unnecessary and that’s a bad thing.

Gmail settings were retrieved instantly and in case you do run into trouble you can manually configure the settings.  We found the dual screen to be very useful here. Read the email and browse through your list of mails at the same time.

I’ll give the mail client, a 7/10. Support for more formats and a bigger attachment size would have made this phone a very nice messaging phone.

Music & Accessories:

Music on the BL40 was an enjoyable one. The phone does not have stereo speakers. It has a single mono speaker which located on the front of the phone. Yes, the earpiece doubles up as the speaker too. The speaker is decent, but don’t expect it to rock a party, unless it’s connected to a better set of speakers via the 3.5mm jack.

With Dolby support and other equalizer settings the BL40 is sure to charm it’s users with some good audio output. The headphones supplied, despite being in ear types were somehow just not comfortable, the left ear’s plug just kept on falling out of my ear. Changing the rubber part to a smaller did not do the trick either. Also they aren’t loud enough, at least not loud enough to really make somebody enjoy their music. At best it can be used for calls and some occasional music listening. These headphones are but by no means drab looking. The white colour coupled with the mic and the call receive button are in a small little enclosure, which is no longer than my thumb’s nail and no thicker than 15-20 sheets of paper stacked together. These may be very unorthodox ways of describing it, but seems perfectly ok, considering that no one except Apple makes such cool looking ear phones.

On the accessory front, the BL40 comes with a high quality screen guard and a layer of stickers to prevent the glossy body from developing scratches. Absence of a memory card is an issue, but the 1.9GB available out of the box to the consumer ensures that one isn’t immediately left handicapped. The data cable was a Micro SD type and it could be connected to the wall charger and used as the power cord in the charger. This is a rather innovative way to ensure that one doesn’t forget the data cable anywhere. It is also a greener way to do things.

I’ll rate the music experience at 8/10. Good music player and a nice set of equalizer settings along with Dolby. Wish the cool looking earphone supplied could enhance the music as much – 7/10 for accessories.

Camera:

Now the camera on the BL40 is a Schneider lens equipped 5MP camera. I am a N82 fan and to me that is the standard to beat for any camera phone to qualify as great. So does the BL40 get there?  No it doesn’t but it sure does leave quite a few players in the dust.

The 5MP camera is quite a snapper and allows for a lot of settings. It won’t be wrong to say that it is in a way a fully functional digital camera, minus the zoom. In fact the UI is also very much like a camera’s dials.

Jesus, I don't even know how many copies of the “Easy Rider” soundtrack I wore out over the years. Anyway, here's to the memory of Dennis Hopper, one of the coolest guys to ever grace the screen.
